BMT Only Representative

BMT offers an Only Representative service to companies outside the EU enabling them to export chemicals into Europe and maintain full control over regulatory compliance. BMT Cordah Ltd, a subsidiary of BMT Group based in the UK, is the EU legal entity that takes on the official role of the Only Representative.

Article 8 of REACH states that manufacturers outside the EU may not act as a registrant, but can appoint a natural or legal entity established in the EU to fulfil, as their Only Representative, the obligations set out in REACH.  Another option for non-EU companies is for their importers to conduct registration, but this option is risky and many importers do not wish to take on such an onerous task.

It is advantageous for non-EU manufacturers to appoint an Only Representative to conduct registration, rather then relying on intermediates (such as importers or distributors) or downstream users; any of which might instead turn to alternative products that have already met the registration requirements. By appointing an Only Representative, non-EU manufacturers retain control over the registration process and may avoid having to disclose some confidential business information to importers and other DU's.

As an Only Representative, BMT become the legal representative of the client for the EU regulatory authorities and all chemicals are registered under the name of BMT. The relationship between the non-EU company and Only Representative has the potential to be indefinite, as the Only Representative is the non-EU company's route into the European market. It is for this reason that we take great pride in the quality of our only Representative services and subsequently became a founding member of the Only Representatives Organisation.
